Terms of Service for itnrry

1. What is itnrry?

itnrry is an AI-powered travel planning platform designed to make exploring the world easier. Whether you are planning your very first weekend getaway or you are constantly on the road, our Service helps you generate personalized itineraries, optimize your routes, dynamically replan your days, and collaborate with friends.

Please note: itnrry is a planning tool. We are not a travel agency, tour operator, airline, hotel, or booking provider.

2. Who Can Use the Service

You must be at least 18 years old (or the age of legal majority where you live) and have the legal capacity to enter into a binding contract to use itnrry. By using the app, you promise that you meet these requirements and will comply with all applicable laws.

3. Your Account and Security

To save itineraries and access certain features, you will need to create an account. You agree to provide accurate information and keep your login credentials secure. You are completely responsible for any activity that happens under your account. If you think someone has gained unauthorized access, please let us know immediately.

4. AI-Generated Content and Its Limits

itnrry uses artificial intelligence to build schedules, suggest activities, and optimize your routes. While our AI is smart, the real world is unpredictable. By using the Service, you understand that:

• AI-generated plans may occasionally contain inaccuracies or outdated information.
• Opening hours, travel times, and availability change constantly.
• You are solely responsible for verifying all travel information (like flight times, reservation requirements, and route safety) before acting on it.
• All AI recommendations are provided strictly for informational purposes.

5. Location Features

Features like automatic activity detection, route optimization, and on-the-go replanning rely on your device's location services. By enabling this, you allow us to process your location as outlined in our Privacy Policy. While these features are designed to be helpful, we cannot guarantee continuous or perfectly precise location tracking at all times.

6. Traveling Together (Collaborative Trips)

Travel is better with friends. If you invite others to collaborate on an itinerary, you grant them permission to view, edit, and modify the trip details. You are responsible for who you invite, and itnrry cannot mediate disputes between you and your travel buddies over who deleted the dinner reservation.

7. Your Content and Our License to Use It

You retain ownership of the content you submit to itnrry, including trip templates, notes, and reviews. However, to operate the app, we need certain permissions. By submitting content, you grant itnrry a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute that content to operate, promote, and improve the Service. You promise that anything you upload belongs to you and doesn't violate anyone else's rights.

8. Public Templates and Community

If you choose to mark a trip template as "public," other users can copy and adapt it for their own adventures. We might also feature your brilliant itinerary in the app. Please note that if you later delete the original public template, copies that other users have already saved will not be deleted.

9. Outside Links and Third-Party Services

Your itinerary may contain links to outside maps, restaurants, ticket vendors, or booking platforms. We do not control these third-party services. If a restaurant is closed or a booking platform overcharges you, itnrry is not responsible. Your interactions with third parties are entirely between you and them.

10. Subscriptions and Billing

If you upgrade to a paid subscription plan, your subscription will automatically renew unless you cancel it. You authorize us to charge your payment method on a recurring basis. Free trials will automatically convert into paid subscriptions unless canceled before the trial period ends. Specific pricing and cancellation terms will be provided at the time of purchase.

11. The Rules (Prohibited Uses)

We want to keep itnrry safe and helpful for everyone. You agree not to:

• Use the app for anything illegal.
• Try to reverse-engineer the app, scrape our data, or exploit our AI systems.
• Upload malicious code or interfere with our security.
• Impersonate someone else or use automated bots without our permission.

12. Intellectual Property

All materials included in the Service, excluding your personal user content, are the exclusive property of itnrry. This includes our software, AI systems, UI design, branding, and logos. You may not copy, distribute, or exploit our proprietary materials without explicit written permission.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, itnrry disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI output. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

14. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall itnrry be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, travel disruptions, personal injury, property damage, or data loss arising out of or in connection with your use of the Service. Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of one hundred U.S. dollars ($100 USD) or the amount you paid to us in the past twelve (12) months.

15. Indemnification

You agree to indemnify, defend, and hold harmless itnrry, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service, your travel activities, your submitted content, or your violation of these Terms.

16. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to them shall be governed by the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts located in British Columbia, Canada, and you consent to the jurisdiction of such courts.

17. Termination

We reserve the right to suspend or terminate your account at any time, without notice, if you violate these Terms or engage in harmful conduct. You may delete your account at any time. Provisions relating to intellectual property, disclaimers, liability, and indemnification shall survive termination.

18. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you via email or an in-app notice. Your continued use of the Service after changes are published constitutes your acceptance of the revised Terms.
